利用規約

この規約は、benriz タイムライン（timeline.benriz.com。以下「本サービス」）を使うときの決まりです。本サービスは、benriz（個人で運営しています。以下「運営者」）が提供する、メモ・日記のアプリです。

1. 規約への同意

本サービスにログインした時点で、この規約とプライバシーポリシーに同意したものとします。
未成年の方は、親権者など法定代理人の同意を得たうえで使ってください。

2. アカウント

本サービスには、自分の Google アカウントでログインします。
アカウントと、AI との連携の管理は、利用者の責任で行ってください。自分のアカウントを通して行われた操作は、利用者本人が行ったものとして扱います。
設定画面の「退会」から、いつでもやめられます。退会すると、アカウントとすべてのデータを、その場で削除します。

3. 使える量

無料で使う場合、合計2万文字までです。タイトルと本文を数え、AI が書いたものも含みます。メモを消すと、そのぶん空きます。
合計がいっぱいになると、新しく書くことはできませんが、読むこと・書き出すこと・消すことは、そのままできます。
有料・無料にかかわらず、1日に書けるのは2万文字までです（AI の暴走や、自動の大量の書き込みを止めるための上限です）。
これらの上限は、変えることがあります。上げるときも下げるときも、お知らせします。

4. 有料の利用

有料の利用（「しっかり使う」）は、設定画面の「プラン」から申し込めます。お支払いは、決済サービスの Stripe の画面で手続きします（カードの番号は、運営者には届きません）。料金・支払い・解約・返金・月払いと年払いの切り替えの条件は、特定商取引法に基づく表記のとおりです。

解約しても、支払い済みの期間が終わるまでは、有料のまま使えます。そのあとは無料の利用に戻ります。メモは消えませんが、無料の文字数をこえているときは、新しく書くことはできません（読むこと・書き出すこと・消すことはできます）。
有料の利用のあいだに退会すると、契約もその場で止まります。

5. AI との連携

利用者は、自分の判断で、外部の AI サービス（Claude、ChatGPT など）を本サービスにつなぐことができます。つないだ AI は、利用者が許可した範囲で、メモを読み書きします。
外部の AI サービスは、それぞれの事業者が提供するものです。その利用には、各事業者の規約が適用されます。
AI が読んだメモは、その AI サービスの事業者に送られます。事業者がそれをどう扱うか（AI の学習に使うかどうかを含みます）は、各事業者の規約と、利用者がその AI サービスで選んでいる設定によります。学習に使われることもあるので、つなぐ前に確かめてください。
運営者は、利用者のメモを AI の学習に使いません。学習のために第三者へ渡すこともしません。
AI が読んだ内容の扱いと、AI が書いた内容の正しさについて、運営者は保証しません。
連携は、設定画面からいつでも取り消せます。

6. 書いた内容

利用者が書いた内容の権利は、利用者のものです。運営者は、本サービスを提供するために必要な範囲（保存、表示、バックアップ）でだけ扱います。
運営者がデータを見る場合の扱いは、プライバシーポリシーのとおりです。
パスワード、API キー、環境変数の値、クレジットカードの番号など、漏れると大きな被害につながる情報は、メモに書かないでください。本サービスはインターネットの上で動いています。メモは保存先で暗号化していますが、運営者と本サービスのサーバーは中身を読める形で扱い、つないだ AI もメモを読めます。
大事なメモは、設定画面の「データの書き出し」で、手元にも保存しておいてください。

7. してはいけないこと

法令に反すること、犯罪に関わること
ほかの人の権利（著作権、プライバシーなど）を侵すこと
不正アクセス、本サービスの弱点を探したり突いたりすること
本サービスに大きな負荷をかけること、上限をすり抜けようとすること
ほかの人のアカウントを使うこと、自分のアカウントをほかの人に貸したり売ったりすること
そのほか、運営者が本サービスの運営のさまたげになると判断すること

8. 利用の停止とアカウントの削除

この規約に反する使い方があったとき、運営者は、利用を止めたり、アカウントを削除したりすることがあります。急ぐ必要があるときを除き、前もって登録のメールアドレスへお知らせします。
無料で利用しているアカウントは、画面を開かない日が90日続くと、アカウントとすべてのデータを削除します。その前に、60日目と85日目ごろに、登録のメールアドレスへお知らせします。くわしくはプライバシーポリシーに書いています。

9. サービスの変更・中断・終了

運営者は、本サービスの内容を変えることがあります。
保守や障害、外部のサービス（Google、Cloudflare など）の不具合のために、前ぶれなく使えなくなることがあります。
本サービスを終了するときは、30日以上前にお知らせします。その間に、データを書き出してください。

10. 保証と責任

本サービスは、個人が運営しています。いつでも使えること、データが失われないこと、不具合がないことは、保証しません。
運営者の故意または重大な過失によって利用者に損害が生じたときは、運営者はその損害を賠償します。
運営者の軽い過失（重大な過失にあたらない過失）によって利用者に損害が生じたときは、運営者は、通常生じる直接の損害に限り、次のどちらか大きいほうの額を上限として賠償します。
- その利用者が、損害が生じた日までの12か月間に、本サービスの料金として支払った額
- 1,800円
利用者どうし、または利用者と第三者（外部の AI サービスの事業者を含みます）とのあいだで起きた問題は、当事者のあいだで解決してください。

11. 規約の変更

運営者は、必要なときに、この規約を変えることがあります。
変えるときは、変更の内容と、いつから変わるかを、このページでお知らせします。利用者に大きく関わる変更は、前もって、本サービスの画面か登録のメールアドレスでもお知らせします。
変わったあとも本サービスを使い続けた場合、変更後の規約に同意したものとします。

12. 準拠法と裁判所

この規約には、日本の法律が適用されます。本サービスについて争いが起きたときは、運営者の住所地を管轄する地方裁判所を、第一審の専属的合意管轄裁判所とします。

Terms of Service

These terms apply when you use benriz Timeline (timeline.benriz.com, the "Service"). The Service is a notes and journal app provided by benriz, which is run by an individual (the "Operator"). This English text is a translation for reference. If it differs from the Japanese text, the Japanese text applies.

1. Agreeing to these terms

By signing in to the Service, you agree to these terms and the Privacy Policy.
If you are a minor, use the Service only with the consent of a parent or other legal guardian.

2. Your account

You sign in to the Service with your own Google account.
You are responsible for managing your account and your AI connections. Actions taken through your account are treated as your own.
You can leave anytime with "Delete account" in Settings. We then delete your account and all of its data right away.

3. Limits

On the free plan, the limit is 20,000 characters in total. Titles and note text are counted, including what an AI wrote. Deleting notes frees up space.
When the total is full, you can't write anything new, but you can still read, export, and delete your notes.
On any plan, you can write up to 20,000 characters a day (a limit that stops runaway AI or automated bulk writing).
We may change these limits. We will tell you whether we raise or lower one.

4. Paid plan

You can sign up for the paid plan under "Plan" in Settings. Payment is handled on the page of Stripe, our payment provider (your card number never reaches the Operator). Prices, payment, cancellation, refunds, and switching between monthly and yearly billing are as stated in the notice under the Act on Specified Commercial Transactions (in Japanese).

If you cancel, you keep the paid plan until the end of the period you paid for. After that you go back to the free plan. Your notes are kept, but if they exceed the free limit, you can't write new ones (you can still read, export, and delete them).
If you delete your account while on the paid plan, the plan stops right away.

5. AI connections

You may choose to connect outside AI services (such as Claude or ChatGPT) to the Service. A connected AI reads and writes your notes within what you allowed.
Outside AI services are provided by their own companies, and their terms apply to your use of them.
Notes that an AI reads are sent to the company behind that AI service. How that company handles them, including whether it uses them to train AI, depends on its terms and on the settings you chose in that AI service. They may be used for training, so check before you connect.
The Operator does not use your notes to train AI, and does not give them to third parties for training.
The Operator makes no guarantee about how an AI handles what it reads, or about the accuracy of what an AI writes.
You can revoke a connection anytime in Settings.

6. What you write

What you write belongs to you. The Operator handles it only as needed to provide the Service (storing, displaying, and backing it up).
Operator access to data is described in the Privacy Policy.
Do not write information that would cause serious harm if leaked, such as passwords, API keys, environment variable values, or credit card numbers. The Service runs on the internet. Notes are encrypted where they are stored, but the Operator and the Service's servers handle them in a readable form, and a connected AI can also read them.
Keep your own copy of important notes with "Export your data" in Settings.

7. What you must not do

Anything that breaks the law or is connected to a crime
Infringing other people's rights, such as copyright or privacy
Unauthorized access, or probing or exploiting weaknesses in the Service
Putting a heavy load on the Service, or trying to get around the limits
Using someone else's account, or lending or selling your own
Anything else the Operator judges to interfere with running the Service

8. Suspension and account deletion

If you use the Service against these terms, the Operator may suspend your use or delete your account. Unless it is urgent, we will email the registered address in advance.
If a free account is not opened for 90 days, we delete the account and all of its data. Before that, we email the registered address around day 60 and day 85. See the Privacy Policy for details.

9. Changes, interruptions, and ending the Service

The Operator may change what the Service does.
The Service may become unavailable without notice because of maintenance, failures, or problems with outside providers such as Google or Cloudflare.
If the Service is going to end, we will tell you at least 30 days in advance. Please export your data during that time.

10. Warranty and liability

The Service is run by an individual. We do not guarantee that it is always available, that data is never lost, or that it is free of defects.
If you suffer damage because of the Operator's intent or gross negligence, the Operator will compensate you for that damage.
If you suffer damage because of the Operator's slight negligence (negligence that is not gross negligence), the Operator will compensate you only for ordinary, direct damage, up to the larger of:
- the amount you paid for the Service in the 12 months before the damage occurred
- 1,800 yen
Problems between users, or between you and a third party (including the company behind an outside AI service), are to be settled between those involved.

11. Changes to these terms

The Operator may change these terms when needed.
When we do, we will post what changes and when on this page. For changes that matter a lot to you, we will also tell you in advance in the Service or by email to the registered address.
If you keep using the Service after a change takes effect, you agree to the changed terms.

12. Governing law and court

These terms are governed by the laws of Japan. For any dispute about the Service, the district court with jurisdiction over the Operator's address is the exclusive court of first instance.
